The Indian Energy Development and
Self-Determination Act, Title XXVI, Section 2604, authorizes the
Secretary to enter into Tribal Energy Resource Agreements with
Indian Tribes. The intent of these agreements is to promote tribal
oversight and management of energy and mineral resource development
on tribal lands and tribal oversight and management of energy and
mineral resource development on tribal lands and further the goal
of Indian self-determination.

This regulation is required by
the new law which is meant to encourage tribes to develop an
overall plan on use of tribal energy resources, eliminating need to
send in individual requests for development if request is in the
approved overall plan.
