This final rule, a follow-up to the
recent systemic risk determination by the Secretary of the Treasury
(after consultation with the President), establishes requirements
and procedures for the Temporary Liquidity Guarantee Program
pursuant to which the FDIC will guarantee payment of certain
newly-issued senior unsecured debt (Debt Guarantee Component) and
certain non-interest bearing transaction accounts (Deposit
Guarantee Component).
The Temporary Liquidity
Program (TLGP), established by the FDIC on October 13, 2008, is
part of a coordinated Federal government response to severe
disruptions in credit markets and a follow-up to the recent
systemic risk determination by the Secretary of the Treasury (after
consultation with the President). An interim rule implementing the
TLGP was published in the Federal Register on October 29, 2008, and
information collections contained in the interim rule were approved
by OMB under emergency clearance procedures on approved by the FDIC
Board on October 23, 2008. The final rule, which was published in
the Federal Register on November 26, 2008 (73 FR 72244), contains
additional information collections necessary for effective program
implementation.
The final rule implementing the
TLG Program includes a requirement for written letter applications
for entities wishing to establish or increase debt guarantee limits
and for certain entities wishing to participate or opt in to the
debt guarantee or transaction account guarantee programs.
