Proposed rule 12d1-4 specifies the
conditions under which a[n] [registered] investment company may
invest in an exchange-traded fund to a greater extent than
currently permitted under the Investment Company Act
US Code:
15
USC 80a Name of Law: Investment Company Act of 1940
The Commission proposed a new
rule, 12d1-4, which would provide exemptions to permit acquiring
funds to invest in ETFs in excess of the limits of section
12(d)(1), subject to conditions that are designed to address the
historical abuses that result from pyramiding and the threat of
large-scale redemptions and that may arise in connection with
investments in ETFs.
