Section 1433(a) of the Small Business
Job Protection Act of 1996 requires that the Service provide
nondiscriminatory safe harbors with respect to section 401(k)(12)
and section 401(m)(11) for plan years beginning after December 31,
1998. This notice implements that statutory requirement.
