The EPA is proposing revisions to the
regulations governing the Federal operating permits. With a
flexible title V permit, the source may make authorized physical
and operational changes without further review or approval. Along
with accompanying changes to the regulations governing the major
New Source Review (NSR) program mandated by parts C and D of title
I of the CAA, the proposed clarifications are intended to provide
increased operational flexibility to sources while ensuring as good
or better environmental protection as under the existing
regulations. The proposed changes represent a potential decrease in
burden to sources related to permit actions.
As a result of the proposed
revisions to clarify the Federal operating permit program
regulations, sources that obtain a flexible permit (after the
initial burden of voluntarily obtaining the permit) will
subsequesntly be able to make authorized changes without revising
their permits, thereby reducing the burden that would have resulted
from those permit actions in the absence of the flexible permit. We
estimate that 10% of sources will obtain a flexible permit that
incorporates advance approval for NSR, and that these sources will
then be able to forego one addtitional significant permit
modification every 5 years and nine additioanl minor permit
modifications per year. We estimate that an additional 20% of
sources will obtain a simpler flexible permit that does not involve
advance approval for NSR, and that these sources will then be able
to forego two additional minor permit modifications per year.
