Section 1233 of the Energy Policy Act
(PL 109-119 Stat. 594, 2005) adds a news section 217 to the Federal
Power Act mandating that FERC establish by rule, regulations to
require each transmission organization to make available long-term
firm transmission rights that satisfy the guidelines established by
FERC in its regulations.
Specifically, the final rule
requires transmission organizations that are public utilities with
one or more organized electricity markets to either file tariff
sheets making long-term firm transmission rights available that are
consistent with each of the guidelines established by the
Commission, or to make a filing explaining how their existing
tariffs already provide long-term firm transmission rights that are
consistent with the guidelines. All of the proposed changes in the
subject Final Rule are provided for under section 217 of the FPA as
added by section 1233 of the Energy Policy Act 2005.
