Application for Exportation of Articles Under Special Bond

A. Justification
1. Form CBP-3495, Application for Exportation of Articles Under Special Bond, is an application for exportation of articles entered under temporary bond at the port of entry or at another port of entry, pursuant to 19 U.S.C. 1202, Chapter 98, subchapter XIII, Harmonized Tariff Schedule of the United States, and 19 CFR 10.38.
2. The Form CBP-3495 is used by importers (and their agents) to notify CBP that the importer intends to export goods that were subject to a duty exemption based on a temporary stay in this country. It also serves as a permit to export as to satisfy the importer's obligation to export the same goods and thereby get a duty exemption. The form is used to identify the exported goods with the original importation.
3. This form will be automated in CBP’s Automated Commercial Environment (ACE). The ACE System is still under development and the automation of the Form 3495 is planned for 2011.
4. The information on CBP-3495 is unique and is, therefore, not duplicated.
5. This information collection does not have a significant impact on small businesses.
6. The consequence to the Federal Government if CBP did not collect this information would be a loss of control of merchandise entered duty free under a temporary importation bond.
7. This information collection is conducted in a manner consistent with the guidelines in 5 CFR 1320.6.
8. Public comments were solicited through two Federal Register notices: a 60-day notice dated April 3, 2007, Vol. 72, Page 15892, and a 30-day notice dated July 27, 2007, Vol. 72, Page 41341. As of this submission, no comments were received.
9. There is no offer of a monetary or material value for this information collection.

12. Estimated Annualized Burden on the Public The estimated burden for this information collection is 2,000 hours. This is based on 500 respondents who average 30 responses each for a total of 15,000 responses. Each response is estimated to require .1333 hours (8 minutes) for a burden of 2,000 hours (15,000 x .1333).
Estimated Annualized Cost to the Public The cost to the respondents is estimated to be $32,040.00. This is based on an estimated 2,000 hours burden at an hourly rate of $ 16.02.
13. Estimated Record Keeping Burden on the Public. There is no record keeping burden associated with this collection.
Estimated Capitalization Cost Burden on the Public. There are no capitalization costs associated with this information collection.
14. Estimated cost to the Government for this information collection is $53,010. This is based upon an estimated 1,767 hours expended at an average hourly rate of $30.00.
15. There are no changes to this information collection.
16. This information collection will not be published for statistical information.
