The Ryan White HIV/AIDS Treatment
Modernization Act of 2006 requires that grantees receiving funds
under Parts A, B, and C expend 75% of funding on core medical
services, including anitretroviral drugs, for individuals with
HIV/AIDS identified and eligible under the legislation. Sections of
the Act permit a waiver with respect to the required portion of
funding for core medical services. In order to request a waiver,
grantees must submit a request and provide supporting information
and documentation along with the grant application to ensure
compliance with the Act.
On December 19, 2006,
the President signed the Ryan White HIV/AIDS Treatment
Modernization Act of 2006. The predecessor statute was the Ryan
White Comprehensive AIDS Resources Emergency (CARE) Act. The 2006
Act requires that grantees receiving funding under Parts A, B, and
C expend 75% of funding on core medical services. The Act permits a
waiver with respect to the required portion of funding for core
medical services, but the waiver request must be submitted with the
grant application. The application must be made available on August
1, 2007 in order to allow 60 days for preparation of the
application and waiver docuemntation, which is due on October 1,
2007. The Act was made retroactive to the beginnin of the 2006
fiscal year, and for that year grantees made a written request with
no documentation. The program has developed the requirements for
documentation that the criteria for a waiver have been met, and
requests emergency processing to ensure agency compliance with the
Act in determining waiver requests.
