Justification for developing the Form OCSE‑75, Child Support Enforcement Program Annual Data Report

A. Justification

1. Necessity of the Information Collected

The Federal Office of Child Support Enforcement (OCSE) oversees the administration of 10 Tribes or Tribal organizations that currently operate child support enforcement programs. The Federal government sets program standards and policy, evaluates Tribal program performance, and offers technical assistance and training to the tribes.

In its oversight role, the Federal government receives data from the Tribes. They then compile and evaluate these data for presentation in the Preliminary and Annual Data Reports. The authority to collect and report information requested on this form is Title IV-D of the Social Security as required by CFR 45 Section 309.170(b)(see Attachment A).

OCSE maintains records of activities performed and reported by Tribes and Tribal Child Support Enforcement organizations and includes these data in preliminary data reports and annual reports to the Congress. The effective date for Tribes to use Form OCSE-75 is October 1, 2006.

Fourteen reporting lines have been developed on the OCSE-75 Tribal CSE Data Report. These lines were developed to allow Tribes and Tribal organizations to report program status and accomplishments.

Tribes will begin using the Form OCSE-75 effective Federal Fiscal Year (FFY) that begins October 1, 2006. The first report is due by October 31, 2007. Tribes or Tribal organizations must report all the information requested on the OCSE-75 by that time.

Attachment B contains the AT, collection instruments, and instructions for completing it.

2. Needs and Uses

The data collected by Form OCSE-75 are used to evaluate tribal IV-D programs and prepare the preliminary and annual reports. In addition, Tribes administering Child Support Enforcement Programs under Title IV-D of the Social Security Act are to report program status and accomplishments for each Tribe on the above form.

3. Use of Information Technology

Not Applicable

4. Efforts to Identify Duplication

The Forms OCSE-75, is the only method used by Tribes and Tribal organizations to report statistical child support information to the Federal government. No data are reported elsewhere and there is no other form in use by OCSE/ACF which collects similar Tribal information.

5. Impacts on Small Businesses

This reporting requirement is imposed on Tribes and Tribal organizations. There are no small businesses contracted to complete this form.

6. Consequences of Less Frequent Collection

The data collected on Form OCSE-75 are used annually by OCSE to evaluate Tribal programs and to identify areas where program improvement may be required and to set in motion tailored strategies for achieving such improvement. Failure to collect this data would preclude the Department from monitoring and evaluating the success of the program.

7. Special circumstance

This collection is conducted in a manner consistent with guidelines in 45 CFR Part 309. There are no special circumstances.

8. Consultations Outside the Agency

This form was developed by Federal representatives. It was circulated in the Federal Register for the sixty-day notice on October 16, 2006 (see attachment) to obtain input from Tribes and Tribal organizations.

9. Paying Respondents

No payments or other remuneration to respondents are made for the collection of this information.

10. Assurance of Confidentiality

The data reported are considered to be public information.

11. Justification of Sensitive Questions

Data are reported only on an aggregate basis. There are no data or personal information of a sensitive nature.

12. Estimate of burden

The burden on all Tribe and Tribal organizations is estimated at 25 hours per year, calculated as follows:

It should be noted that this estimated time required per response is the average of all Tribes.

13. Estimate of Cost Burden

The Tribes are already collecting most of the data required, therefore, no additional cost is required.

14. Cost to the Federal Government

Cost to the Federal Government are estimated at $5,000 for printing, distribution, tabulation, and analyzing the data.

15. Reason for Changes in Burden

This is a new collection instrument. There is currently no OMB inventory on this instrument.

16. Project Schedule

Information on this form will be published in aggregate on a Tribe‑by‑Tribe basis. The data are published at the end of each fiscal year in a preliminary report and an annual report and is included in other agency publications that highlight child support data.

17. Reasons for not Displaying the Expiration Date

The expiration date will be displayed.

18. Exceptions to the Certification Statement

There are no exceptions to the certification statement.

This collection does not necessitate the use of statistical methods.
