Justification of Nonmaterial, Nonsubstantive Change in ICR for No. 1210-0127
On February 15, 2007, the Department of Labor published proposed amendments to Prohibited Transaction Class Exemption 2006-06 and interim final amendments to its regulation at 29 CFR 2550.404a-3. See 72 FR 7461, 7516. The regulation and exemption provide rules, guidance, and a fiduciary safe harbor for the termination of abandoned individual account plans. The Department also published changes to the model Notice of Plan Termination that was provided as part of the promulgation of the regulation for use by the public in connection with plan terminations under its provisions. See 72 FR 7521. These revisions to regulation, class exemption, and model notice do not affect the burden analysis for the ICR approved under OMB Control No. 1210-0127, currently scheduled to expire on April 30, 2008. However, the Department is submitting the Federal Register documents showing the changes to regulation, exemption, and model form in order to ensure that the docket for OMB Control No. 1210-0127 contains the current information collection instruments for this ICR.
