Justification
1. This form is prescribed by the Department of Homeland Security, Bureau of Customs and Border Protection (CBP), for use by masters, owners, or agents of vessels in complying with Sections 231 and 251 of the Immigration and Nationality Act. Where appropriate, copies of the form are provided to the U.S. Public Health Service. Sections 231 and 251 of the I&NA prescribe that upon the arrival of any person by water or by air at any port within the United States from any place outside the United States, it shall be the duty of the master or commanding officer, or authorized agent, owner, or consignee of the vessel or aircraft, having any such person on board to deliver to the immigration officers at the port of arrival typewritten or printed lists or manifests of the persons on board such vessels.
This form is for use by masters, owners or agents of vessels in complying with sections 231 and 251 of the Immigration and Nationality Act. These forms shall contain such information as is necessary for the identification of the persons transported and for the enforcement of the immigration laws. This version makes the form a “traveling manifest” to be updated, as necessary, from the time a vessel arrives in the United States until it departs, whereas previous versions of the form required that an “arrival manifest” be submitted upon arrival and a separate “departure manifest” (reflecting crew changes) be submitted at departure. The revised form also incorporates a proposed itinerary for the vessel and a receipt for the submission of the form.
The Form I-418 is filled out on vessels. Upon arrival, it requires an endorsement by CBP officers. Therefore, it is not appropriate to submit this form electronically.
A review of the CBP Forms Inventory Report revealed no duplication of effort, and there is no other similar information currently available, which can be used for this purpose.
This collection of information does not have an impact on small businesses or other small entities.
Under section 231 of the I&NA, no master or commanding officer of any such vessel or aircraft shall be granted clearance papers for his or her vessel until he or she, or the authorized agent has deposited such list or lists and accompanying documents with the immigration officer at such port.

Federal Register Notices were published on September 18, 2006 and November 24, 2006 requesting public comments. As of this submission, no comments have been received.
CBP does not provide payment or gifts to respondents in exchange for a benefit sought.

The annual reporting burden is 95,000. This figure was derived by multiplying the number of respondents (95,000) x frequency of response (1) x hours per response (1). This estimation is based on prior CBP experience with the program.

There are no capital or start-up costs associated with this information collection. Any cost burdens to respondents as a result of this information collection are identified in Item 14. There is no fee associated with this information collection.

The estimated cost of the program to the Government is $2,850,000. This figure is calculated by using the estimated number of respondents (95,000) multiplied (x) by one hour x $30 (average hourly rate).
