The agency is
reminded of the need to provide a thorough justification pursuant
to 5 CFR 1320.12(a): §1320.13 Emergency processing. An agency head
or the Senior Official, or their designee, may request OMB to
authorize emergency processing of submissions of collections of
information. (a) Any such request shall be accompanied by a written
determination that: (1) The collection of information: (i) Is
needed prior to the expiration of time periods established under
this Part; and (ii) Is essential to the mission of the agency; and
(2) The agency cannot reasonably comply with the normal clearance
procedures under this part because: (i) Public harm is reasonably
likely to result if normal clearance procedures are followed; (ii)
An unanticipated event has occurred; or (iii) The use of normal
clearance procedures is reasonably likely to prevent or disrupt the
collection of information or is reasonably likely to cause a
statutory or court ordered deadline to be missed.

This document provides guidelines
under § 170(n) for substantiating certain expenses of carrying out
sanctioned whaling activities.
This is submitted for
emergency approval. Section 170(n) is effective for contributions
made after December 31, 2004. Taxpayers are in need of this
guidance prior to the end of the fall whaling season and the year
end to identify all appropriate expenses for the calendar year
2006. Also, taxpayers who are filing for the 2005 calendar year on
extension whose returns are due September 15, 2006. Failure to
provide immediate guidance may result in irreparable harm to
taxpayers using ' 170(n).
This is a new ICR, with changes
to the current procedures for reporting whaling expenses. This new
RP results in 48 new burden hours.
