The information will be used by EPA or
Tribal enforcement personnel to: (1) identify major and minor
sources, new or modified, subject to the NSR rules, (2) ensure that
control technology, if required, is being properly applied, and (3)
ensure that the emission control devices are being properly
operated and maintained on a continuous basis. Based on the
reported information, the EPA or Tribal agency can decide which
plants, records, or processes should be inspected. Potential
respondents are owners or operators of all new minor stationary
sources and minor modifications (to both minor and major sources)
in Indian Country, and those new major stationary sources and major
modifications located in portions of Indian Country that are in
nonattainment areas.

The increase of burden for this
proposed rule represents a placeholder of 1 hour. The proposed
action would establish nationally applicable regulations to
implement a permitting program in Indian country, which would
regulate the construction and modification of stationary sources of
air pollution and allow certain new and existing stationary sources
to voluntarily accept federally enforceable emission limits in
order to avoid major source regulations. With this action, EPA is
proposing regulations to regulate new minor stationary sources and
minor modifications in Indian country, i.e., a federal minor NSR
rule. However, no specific language is included for the federal
major nonattainment NSR rule because it is already provided in 40
CFR 51.
