Justification for Change (1010-0041)
At the proposed rule stage for this cost recovery rule, OMB gave MMS permission to make new fees/fee changes without an OMB 83-I.
This submission shows a program change to 1010-0114 due to rulemaking 1010-AD16, 70 FR 49871, August 25, 2005. Fees from the cost recovery rule were inappropriately calculated and added in a previous 83C submission (approved under Notice of Action, July 11, 2006). MMS had not accounted for the number of submissions times each fee in the 83C that was submitted to OMB. With this submission, we are requesting a program change to these fees.
