The previous
Terms of Clearance for this Information Collection stated: "This
Information Collection is approved with the understanding that EPA
will change its policy statement so that respondents have 30 days
to provide TSCA 8(e) information to EPA. 30 days is the minimum
amount of time in which an agency can require a respondent to
provide information (5 CRF 1320.5 (d) (2) (ii))." EPA currently
requires reporting within 15 business days. Because of EPA's
failure to meet the terms of clearance, this ICR is approved for
two years to enable EPA to make the requisite changes. This
Information Collection is approved with the understanding that EPA
will either change its policy statement so that respondents can
meet the TSCA section 8(e) requirements to "immediately inform" EPA
by providing the TSCA 8(e) information within 30 days or provide an
explanation for adopting a more stringent reporting period. It is
our understanding that EPA is in the process of revising its policy
statement. The Agency should submit to OMB a report on the status
of the policy statement 9 months after this approval.
