This ICR is
approved. One commenter raised concerns with the burden imposed by
CBI substantiation requests and suggested that the agency identify
categories of information that would automatically be granted CBI
status, and for which substantiations would thus not be required.
The supporting statement for the ICR indicates that the agency is
currently exploring a series of issues related to revising and
streamlining its CBI regulations, and that it intends to publich an
ANPRM requesting comment on these issues shortly. The supporting
statement further indicates that one issue on which comment will be
requested is the appropriate use of class determinations. OMB
supports EPA's efforts to revise and streamline its CBI rules and
believes that the ANPRM is a positive step forward in addressing
the commenter's concern.
