This ICR is
approved. It covers three specific information collection
requirements: 1) submission of no exposure certifications by Phase
I industrial facilities; 2) review of no exposure certifications by
NPDES authorized states; and 3) designation of additional MS4s
outside of urbanized areas that will be required to obtain permit
coverage under the Phase II rule by NPDES authorized states. No
other information collection requirements of the Phase II rule are
approved through this ICR. Also note that EPA has assumed that
NPDES authorized states will gather the information necessary to
support MS4 designation decisions from existing sources, without
requiring additional information to be submitted from potentially
regulated MS4s themselves. Thus, this ICR does not authorize any
collection of information from such MS4s for this purpose.
Additional information requirements contained in the Phase II rule
do not become effective until after the three year term of this ICR
approval. When this ICR is renewed, EPA will need to obtain
approval for these additional information collection
requirements.

This ICR calculates the burden and
cost associated with the regulation of storm water discharges under
Phase II of the NPDES storm water program. Specifically, it
calculates the burden for submitting a no-exposure certification.
The ICR specifies the burden on authorized NPDES States to process
and administer the Phase II program, including designation of
additional small municipal separate storm sewer systems
(MS4s).
