This emergency
clearance was made necessary only by SBA's failure to comply with
the Paperwork Reduction Act procedures for OMB review of
information collections in a proposed rule. SBA is instructed to
immediately review 44 U.S.C. Chapter 35 and 5 CFR 1320, with
specific attention to 44 U.S.C. 3506(c)(2)(B) and_5 CFR 1320.11,
and integrate compliance with internal rule reviews. Prior to
submission of this information collection request for a full three
year approval, the agency must review data matching opportunities
with other Federal programs to eliminate the last question on page
3. The agency must also describe precisely how the agency uses the
information in Section C and, if it doesn't use the information
when submitted, any real instance of the information being used by
the agency.

The SBA is required by the HUBZone Act
of 1997, title VI of Public Law 105-135, to administer the HUBZone
Program. The program requires that small business concerns apply to
SBA for certification for the program. The SBA will use the
information submitted on the application form to determine
eligibility in the program and, as required by statute, to report
to Congress on the various aspects of the program. The respondents
will be small business concerns applying for certification as a
qualified HUBZone small business concern.
