consistent with ED's memos and revisions of 1/26/99. In addition,
the following terms apply: 1) OMB notes that by issuing the
guidance document entitled *Guidance for FY 1999 State Plan
Requirements* (program memorandum FY 99 - 2), ED was in violation
of the Paperwork Reduction Act. Specifically, this guidance spelled
out specific reporting requirements that States would need to
comply with in order to receive Federal monies. However, ED did not
obtain an OMB control number for this guidance and failed to
indicate that the reporting requirements outlined in the guidance
were not enforceable until an OMB control number was obtained. This
violation will be noted in ED's FY 1999 Information Collection
Budget. 2) Because this emergency clearance process did not provide
the public with a significant amount of time with which to comment
on ED's implementation of the Adult Education and Family Literacy
Act (P.L.105-220), within 1 month of this clearance, ED shall
publish in the Federal Register a Notice that (a) requests public
comments on the implementation of P.L. 105-220), and (b) requests
public comment on ED's decision not to regulate in implementing
P.L. 105-220.
