EOIR-42 collection is revised (1125-0001) the form shall include a
note that applicants under NACARA are to use the I-881. Note that
this form was previously submitted as 1115-0222 and subsequently
withdrawn. OMB's comments on that submission and the responses from
INS are included in this package.

This form is used by nonimmigrants to
apply for suspension of deportation or special rule cancellaltion
of removal. The information collected on this form is necessary in
order for the INS to determine if it has jurisdiction over and
individual applying for this release, as well as to elicit
information regarding the eligibility of an individual applying for
this release, pursuant to section 203 of the Nicaraguan Adjustment
and Central American Relief Act (NACARA); Public Law
105-100.
