for Exemption from the Prohibited Transaction Provisions of Section
408(a) of the Employee Retirement Income Security Act (ERISA)
Extension without change of a currently approved collection
Section 408(a) of the Employee
Retirement Income Security Act (ERISA) authorizes the Secretary of
Labor to grant exemptions from the prohibited transaction
provisions of sections 406 and 407(a) of ERISA and directs the
Secretary to establish an exemption procedure with respect to such
provisions. This regulation provides this procedure which requires
applicants for exemption to make certain disclosures to the
Department of Labor and to participants and beneficiaries.
On behalf of this Federal agency, I certify that
the collection of information encompassed by this request complies
with 5 CFR 1320.9 and the related provisions of 5 CFR
1320.8(b)(3).
