collection (Request for a new OMB Control Number)
Approved as
amended by and consistent with ED's memos, revisions, and
attachments of 8/21/98 and 8/25/98. In addition, ED agrees to the
following conditions: 1) ED will revise all sections of Table 5 so
that any data requested by ED that is not specifically required by
Sec. 618(a)(1)(A)(vii) of the IDEA 1997 Amendments will be optional
for the first year this collection is implemented (i.e. academic
year 1998 - 1999). For example, any request ED makes for data that
is broken down by race/ethnicity and disability beyond what is
specifically referenced in 618(a)(1)(A)(vii)(I) will be optional
reporting. 2) ED will inform respondents that it is ED's intention
to change the aforementioned optional reporting requirements to
mandatory for the second year of this collection's implementation
(i.e. academic year 1999 - 2000). However, prior to implementation
of a mandatory reporting requirement for any data not specifically
required by Sec. 618(a)(1)(A)(vii), ED must take the following
steps: a) submit to OMB an addendum to this package with the
revised forms and instructions, b) submit to OMB an analysis which
assesses the burdens imposed by reporting requirements additional
to those specifically required by Sec. 618(a)(1)(A)vii relative to
the utility of this data, c) based on this analysis, OMB will
either approve or disapprove this requested addendum. 3) ED will
revise Table 5 so that all requests for data based on 'multiple
short-term suspensions summing to > 10 days' will be optional
until the final regulation is issued by ED. Once the final
regulation is issued by ED, then ED will inform the states in a
manner ED finds least burdensome (e.g., letter to chief state
school officers) of any changes to this category of data that may
result from the final regulation. At that point in time, ED can
change the 'optional' status of this data category to 'mandatory'
for any data ED collects related to 'multiple short-term
suspensions' consistent with what is required under Sec.
618(a)1(A)(vii)(III). 4) ED will send the revised Table 5 to OMB
for an expeditious review prior to sending it to respondents. 5) ED
will submit to OMB for review any changes to this paperwork that
result from any regulatory changes affecting IDEA. 6) ED will
submit to OMB a copy of OSEP responses to public comments
consistent with ED's response #8 on the 8/21 memo. 7) OSEP will
continue their efforts with OCR and OERI to develop a combined data
collection for the Year 2000 which coordinates ED's request for
information on discipline and minimizes burden on the public by
eliminating reporting requirements that may appear duplicative to
respondents filling out the CCD, the civil rights compliance
report, and this OSEP form.

This package provides instructions and
a form for States to report the number of children and youth and
the number of acts involving students served under IDEA involving a
unilateral change in placement, change in placement based on a
hearing officer determination, or long-term suspension/expulsion.
The form satisfies reporting requirements and is used by OSEP to
monitor SEAs and for congressional reporting.
