This ICR is
approved on an emergency basis for 6 months, in order to allow EPA
time to include appropriate supporting documentation and burden
estimates for additional paperwork requirements associated with the
storm water general permit that were not included in the current
submission. Because opportunity for public notice and comment was
already provided through the proposal of the permit itself, the
agency does not need to provide an additional 60-day comment period
for the resubmission. However, the agency should notice the revised
submission in the FR at the time it is resubmitted to OMB and allow
the standard 30-day comment period at that time. The revised
submission should also cover reporting and recordkeeping
requirements of storm water general permits issued by states with
delegated programs, unless the agency determines that these
requirements have already received PRA approval under another
ICR.

Section 402 of the Clean Water Act
establishes the NPDES program to regulate the discharge of any
pollutant or combination of pollutants from point sources into
waters of the United States. CWA section 402(p) authorizes the
Administrator to issue permits for stormwater discharges.
Stormwater regulations are found in 40 CFR part 122. EPA needs the
information collected in the construction NOI to provide coverage
to applicants for stormwater discharges associated with
construction activity under the NPDES Construction Stormwater
General Permit.
