FCC should take
steps to ensure that filings necessary to determine whether
applications are mutually exclusive are minimized. OMB is also
concerned about entities that have previously filed in accordance
with rules prevalent at the time of their applications. These
entities have incurred financial and other burdens in preparing for
comparative hearings. The FCC should weigh these factors in this
rulemaking.

This NPRM seeks comments on proposed
competitive bidding procedures for AM, FM, TV, LPTV, and FM and TV
translator commercial broadcast stations authorized under section
309(j) of the Communications Act of 1934, as amended. This NPRM
also seeks comments on whether it must use auctions to resolve
competing ITFS applications. The data proposed to be collected
would be used to determine initial eligibility to participate in a
broadcast auction.
