This collection
is approved under the following conditions as agreed to by ED: (1)
Since States will not be able to provide data about items not
specifically required by the statute, ED shall allow States for
both the 95-96 and 96-97 school years to provide as much of the
information requested in the form as possible, but not require
information beyond what is required by statute. ED shall send OMB a
copy of the letter to States which indicates this change. (2) ED
shall revise the collection to collect data by school groups (e.g.
elementary, middle, and high school) rather than collect data for
each grade level. ED shall submit a copy of the revised collection
to OMB prior to sending it out to the field.

The Gun-Free Schools Act (GFSA)
requires each State to provide annual reports to the Secretary
concerning implementation of the Act's requirements regarding
expulsions from schools resulting from weapons violations. The GFSA
requires the Secretary to report to Congress if any State is not in
compliance with the GFSA and requires the Secretary to collect data
on the incidence of children with disabilities engaging in
threatening behavior or bringing weapons to schools.
On behalf of this Federal agency, I certify that
the collection of information encompassed by this request complies
with 5 CFR 1320.9 and the related provisions of 5 CFR
1320.8(b)(3).
