These amendments
to the ICR are not approved, and the ICR is continued, under 5 CFR
1320. EPA has not demonstrated that the information to be recorded
and collected is the least burdensome necessary for the proper
performance of the agency's functions, as required under 5 CFR
1320.5(d)(1)(i). For example, the requirements for certified
reclaimers and laboratories to submit MONTHLY processing reports to
their respective certific- ation programs seems unnecessarily
burdensome. If EPA resubmits these amendments to this ICR it shall
explain how EPA makes actual and timely -- not just theoretical or
potential -- use of this information (See Sec 1320.3(l)), or
require the information to be submitted only as frequent as the
agency makes use of it. The agency has also failed to adequately
assess the effect of of less frequent collection. The section 5.c)
on page 8 of the supporting statments provides only EPA's typically
uninformative boilerplate language, and failed to consider possible
methods to reduce the collection frequency, and why the agency has
not adopted such alternatives. EPA should also note that the ICR
was NOT submitted to OMB on or before the date of publication of
the Proposed Rule in the Federal Register (Feb 29,1996), as is
called for under Section 1320.11(b). EPA also failed to provide in
the Fed. Reg. notice a meaningful summary of the collection of
information and the associated burden, as required under 5 CFR
1320.5(a)(1)(iv).

EPA is requesting that persons wishing
to use a proposed contractor reclamation option maintain records
concerning where the refrigerant is stored. In addition, EPA is
proposing to establish third-party reclamation and laboratory
programs that will require recordkeeping and reporting.
