This ICR
associated with the proposed Novermber 1993 CAIR amendments is not
approved. EPA has not demonstrated that it has adopted the least
burdensome approach given its programatic needs (see 5 CFR 1320.4)
Several options were presented in the notice hat could further
reduce burdens, such as alternative low volume and "de minimis"
exemptions. In addition, EPA has extended the public comment period
until March, 1994, so the ICR review cannot benefit from comments
received on the proposed rule, as discussed in the generic terms of
clearance (see April 30, 1993 Notice of Action). However, EPA
should be commended for proposing changes to CAIR that will
generally reduce burden in response to respondent petitions. In
addition, EPA has tried to minimize the number of questions
chemical producers and users will have to answer. EPA should cite
OMB comment number 2010-0019 when submitting the ICR associated
with the final rule and provide a summary and response to OMB and
public comments (draft final preamble, if complete, could suffice
as the necessary document).
