The annual LBP
activity report is approved for use through 6/94. The monitoring
checklist is not approved for use at this time. For the annual
report, HUD should state clearly on the form or its instructions
what its authority is for the collection of information. Upon the
next submission of this report for OMB approval, HUD shall provide
a description of the status of the new data base that contains the
annual report data as well as data from the one-time historical
report (2577-0176). The monitoring report has not been approved at
this time because the practical utility has not been well
demonstrated and the burdensomeness of the checklist has not been
justified. HUD must explicitly state its authority for the
collection of this information. In addition, the clarity of the
form must be improved to ensure that respondents are not misled
regarding the differences between mandatory statutory or regulatory
requirements and the Interim LBP Guidelines which are not
mandatory. Are 24 CFR 905.565 and 570 legitimate citations (they
are not in the 4/1/92 CFR)? HUD should consider drawing attention
on the form or through accompanying correspondence that the
checklist is partially intended to assist HAs understand

HOUSING AUTHORITIES (HAS) ARE REQUIRED
TO MAINTAIN RECORDS ON TENANT NOTIFICATION, TESTING BY LOCATION,
AND ABATEMENT BY LOCATION AND METHOD. THESE HAS ARE ALSO REQUIRED
TO PROVIDE TENANTS AND PURCHASERS A COPY OF ALL POSITIVE LEAD-BASED
PAINT TEST RESULTS. HAS WILL REPORT ANNUALLY THE LEVEL OF
LEAD-BASED PAINT ACTIVITIY.
