This ICR for the
proposed Development and Approval Guidance for Coastal Nonpoint
Pollution Programs is approved on the condition that EPA
reestimates the programs' burden. The current burden estimate
appears to underestimate the resources states will need to
implement the proposed management measures. EPA should reassess the
burden on states for selecting source categories and appropriate
management measures. EPA should also assess whether required
management measures will impose any reporting or recordkeeping
requirements on th regulated community. With the above analysis,
OMB will be better able to determine whether the collection of
information for the whole progr has practical utility as required
under 5 CFR 1320.4(c). EPA must submit a new ICR if the paperwork
burdens of the final rule are materially or substantially changed
from this ICR. If no change is made, an ICW with the approved
burden hours must be submitted to OMB for action.

THE GUIDANCE DOCUMENT IMPLEMENTS
SECTION 6217 OF THE 1990 COASTAL ZONE ACT REAUTHORIZATION
AMENDMENTS. THE GUIDANCE REQUIRES 29 COASTAL STAT WITH APPROVED
COASTAL MANAGEMENT PROGRAMS TO SUBMIT COASTAL NONPOINT PROGRAMS TO
EPA AND NOAA FOR JOINT REVIEW. THIS ONE-TIME SUBMITTAL WILL BE USED
TO DETERMINE IF STATES RECEIVING CWA SECTION 319 AND CZA SECTION
306 FEDERAL GRANTS WILL FACE REDUCTIONS IN FISCAL YEAR 199
