current clearance through January 1993. In the preamble to the
final regulation that underlies this State Plan, and in the
justification for ED's resubmitted collection request, ED shall
respon to public comment about the burden and practical utility of
regulatory provisions that include information collection
requirements Specifically, OMB has concerns about the potential
burden imposed on States due to ED's proposed modification of State
complaint procedures The NPRM proposed that all States, for every
complaint, must: -- make an independent determination, based on all
relevant informatio as to whether a complaint is valid; and --
issue a written decision to the complainant that contains findings
fact, conclusions, and reasons for the decision. Such a procedure
goes well beyond current requirements of this kind, which are
outlined in EDGAR. ED's final analysis should also assess t
practical utility and Federalism implications of its proposal,
based o comments received from States, parents, and other
interested parties about the extent of need for more stringent
standards. This analysis should also assess how many States were
found to have problems with their complaints procedure, how many
parents appealed State decisions, and what percent this constituted
of all complaints. -- Last, ED's State Plan text should change
"handicap" to "disability"
