We have approved
these reporting requirements through September 1992, the statutory
completion date for monitoring seasonal farmworkers unde this
section of the 1986 Immigration and Nationality Act. DOL has agreed
to delete the separate reporting column for "sugarcane" workers
pursuant to resolution of a recent court case. DOL shall submit to
OM a revised copy of the ESA-92 as soon as such corrections are
made.

SECTION 210A OF THE IMMIGRATION AND
NATIONALITY ACT REQUIRED EMPLOYERS OF REPORTABLE WORKERS IN
SEASONAL AGRICULTURAL SERVICES THROUGH SEPTEMBER 30, 1992, TO
CERTIFY SUCH WORKER'S EMPLOYMENT TO THE FEDERAL GOVERNMENT. THIS
INFORMATION USED TO DETERMINE THE NUMBER OF WORKERS TO BE ADMITTED
TO THE U.S. TO MEET ANY SHORTAGE.
