In response to
the Department's letter of August 1, 1990, we wish to point out
that the Paperwork Reduction Act (sec. 3512) states
"Nothwithstanding any other provision of law, no person shall be
subject to any penalty for failing to maintain or provide
information to any agency if the information request involved was
made after December 31, 1981, and does display a current control
number assigned by the Director, or fails to state that such
request is not subject to this chapter."

THE ADOPTION OF THESE CLASS EXEMPTIONS
UNDER THE EMPLOYEES' RETIREMENT SYSTEM ACT (FERSA), WOULD PERMIT
FIDUCIARIES WITH RESPECT TO THE FERS THRIFT SAVINGS FUND TO ENGAGE
