EPA has done a
very good job by initiating changes to the rules governing section
12(b) notification of export chemical subject to section 5 test
rules that will reduce paperwork burden. However, EPA shall
consider extending the annual notification (rather then per
transaction) to chemicals subject to section 4 (i.e. SNURs), as
well. In addition, EPA should adopt, or justifiy why it is not
feasible to adopt, a de minimus concentration exemption for export
chemicals. Thu OMB is not approving this ICR under 5 CFR 1320
because the collection is not the least burdensome necessary for
the proper performance of the Agency's functions. When the
information collection in the final rule are submitted f PRA
review, EPA shall place the OMB comment number 2070-0030 in item 2
on the SF 83. OMB is not providing an approval number at this
time.
