days with the following conditions. HUD must indicate why annual
inspections of residences are now necessary for the proper
functioning of this program. HUD's response should also provide a
justification for the requested periodicity of such inspections.
(See 24 CFR 905.417.) The inspection periodicity at section 5.1(b)
of the "Agreement" is not approved. The requirement to inspect
residences at least once every three months during contractor
warranty periods is not required by regulation and has not been
adequately justified as the most appropriate periodicity for
collecting the required information. HUD must also revise the
Agreement to bring it into compliance with the requirements at 5
CFR 1320.4(a) and 1320.21.
