Terms of Clearance: APPROVED. WE NOTE THAT THE CRA NOTICE REQUIREMENTS AT 12 CFR 345.6 ARE NOT SUBJECT TO OMB REVIEW UNDER THE PAPERWORK REDUCTION ACT. OUR REGULATION IMPLEMENTING THE ACT AT 5 CFR 1320.7(c)(2) STATES THAT "THE PUBLIC DISCLOSURE OF INFORMATION ORGINALLY SUPPLIED BY THE FEDERA GOVERNMENT TO THE RECIPIENT FOR THE PURPOSE OF DISCLOSURE TO THE PUBLI IS NOT INCLUDED" WITHIN THE DEFINITION OF A COLLECTION OF INFORMATION. HOWEVER, IT APPEARS THAT THE CRA NOTICE REQUIREMENTS, INCLUDING THE REQUIREMENT TO REVISE THE NOTICE IF A BANK'S HOLDING COMPANY STATUS CHANGES, MAY LACK PRACTICAL UTILITY AS IT APPEARS THAT FEW INDIVIDUALS ARE AWARE OF THE NOTICE OR OF THE CRA REQUIREMENTS. IT MAY BE USEFUL FOR THE FDIC, IN CONJUNCTION WITH THE OTHER FEDERAL BANK REGULATORS, TO INVESTIGATE THE PRACTICAL UTILITY OF THIS NOTICE REQUIREMENT AND TO MAKE ANY CHANGES OR REVISIONS DEEMED APPROPIATE, TAKING INTO CONSIDERATION BOTH THE BENEFITS TO THE PUBLIC OF SUCH NOTICE AND THE BURDENS IMPOSED ON THE BANKING INDUSTRY.
