DATE. OSM AGREES TO CHANGE THE JUSTIFICATION AND ASSOCIATE BURDEN
HOURS IF THE FINAL RULE ON HYDROLOGIC BALANCE PROTECTION WARRANTS
SUCH A CHANGE. THE PREVIOUS TERMS OF CLEARANCE STILL HOLD I.E., OSM
AGREES TO MORE CLOSELY EXAMINE THE BURDEN ESTIMATES THROUGH
SOLICITATION OF COMMENT IN THE NPRM, SURVEYS OF LESS THAN TEN
RESPOND ENTS, AND, IF NECESSARY LARGER SURVEYS. OSM HAS ALSO AGREED
TO REVIEW THE REGULATIONS AND TO LOOK FOR FURTHER BURDEN HOUR
REDUCTIONS, SPECIFICALLY LOOKING AT REQUIREMENTS THAT ARE
COMPARABLE TO THOSE UNDER THE CLEAN AIR ACT AND THE CLEAN WATER
ACT.
