annual use only. BATF has failed to justify that quarterly
reporting is necessary for the proper performance of the agency's
functions as required by 5 CFR 1320.4 (b) (1). BATF has failed to
demonstrate that quarterly reporting has enabled it to account for
significant, otherwise unreported, production of firms going
out-of-business. BATF also has failed to show that there are no
practical means for identification of manufacturers going out-of
business in time to obtain records of production. BATF's argument
that quarterly reporting is needed to detect errors in reporting is
no supported. By this reasoning no annual reporting could be
acceptable. BATF should explore alternative means for discovering
gross errors in reporting.
