Abstract: SECTION 4(C) OF THE SERVICE CONTRACT ACT PROVIDES THAT WHERE NEGOTIATE WAGES AND FRINGES APPEAR TO BE SUBSTANTIALLY AT VARIANCE WITH THOSE THAT PREVAIL IN THE LOCALITY OF PERFORMANCE, THE AFFECTED PARTY(S) MAY REQUEST A HEARING TO ESTABLISH PREVAILING RATES. IT IS NECESSARY TO CONDUCT A SURVEY OF SIMILAR OPERATIONS UTILIZING THE JOB CLASSIFICATIONS IN QUESTION WITHIN THE LOCALITY FOR THIS PURPOSE.
