OMB approves
this ICR except as the requirements of 40 CFR 61.94 apply to DOE
facilities that contribute less than 5 mrem/yr to the whole body or
15 mrem/yr to a critical organ of any member of the public. Richard
Guimond, from EPA's Office of Radiation Programs, explained to us
that it was the intention of 40 CFR 61.98 to exempt such
facilities, and that the failure of the rule to do so is a drafting
error that will be corrected. Thus, this clearance includes the
intended exemption for low emitting DOE facilities. EPA is urged to
make this correction expeditiously. If unable to do so, the agency
should inform OMB so that appropriate action under the PRA can be
taken and this ICR modified.
