Terms of Clearance: As indicated in 5CFR1320.6, OMB will not approve a collection of information requiring respondents to submit more than an original and two copies of any document in the absence of an agency demonstration that such collection of information is necessary to satisfy statutory requirements or other substantial need. The Department has failed, however, to justify the requirement for taxpayers to provide copies of Form 5110.53 in quadruplicate. Thus, we have approved this collection of information until October 1985 with the condition that the Department will initiate rulemaking in accordance with 5 CFR 1320.14 ( to amend 27CFR250.81(a) to eliminate the requirement for copies in excess of an original and two copies as prescribed in 5CFR1320.6(c). I addition, the justification statement for this docket should be amende to make explicit that the request for OMB clearance includes the underlying regulation at 27CFR250.81(a).

Abstract: THIS FORM IS NECESSARY TO DOCUMENT THE LIABILITY OF TAX AND THE TAX PAYMENT ON DISTILLED SPIRITS THAT ARE BROUGHT INTO THE U.S. THIS LIABILITY IS RECEIVED BY THE GOVERNMENT IN THE MANNER OF HAVING THE TAXPAYER PREPAY THE TAX BEFORE LEAVING PUERTO RICO. THE FORM THE FORM IDENTIFIES THE TAXPAYER, TAX TO BE PAID55, METHOD OF PAYMENT, IDENTIFIES THE TAXPAYER, TAX TO BE PAID, METHOD OF PAYMENT, SHIPMENT AND CERTIFICATION BY THE GOVERNMENT.
