The proposed
paperwork is approved through March 1986. If the Department seeks
an extension of this clearance, it should submit a new paperwork
package thoroughly justifying: 1. the use of payroll records in
determining average U.S. worker productivity, and 2. the need for
all employers of alien agricultural workers to submit payroll
records (as opposed to only a sample of such employers providing
this information).

UNDER REGULATION 20 CFR 655.207(C), A
GROWER MUST PAY A PIECE RATE WHI ENABLES THE AVERAGE U.S. WORKER TO
EARN THE ESTABLISHED HOURLY RATE WITHOUT HAVING TO INCREASE
PRODUCTIVITY. PAYROLL RECORDS ARE NEEDED T CHECK COMPLIANCE.
RESPONDENTS WOULD BE MOSTLY FRUIT GROWERS USING BOTH ALIEN AND U.S.
WORKERS.
