We raised a
concern with the agency in our clearance dated 4/17/84, which has
not been addressed at all in this request for clearance of the
recordkeeping requirements dated 11/21/84. We are concerned that
the need and purpose of these records are not clear. Other
approaches, such as a certification, would seem to meet the
agency's needs and would impose a lesser burden on the public. We
have, therefore, retained the clearance for the recordkeeping
requirements in the existing rules through 4/86 at which time the
agency will have completed a notice of proposed rulemaking. With
the submission of the notice of proposed rulemaking, we will review
the agency's response to these concerns.
