Abstract: 29 USC PARA 1400 REQUIRES MULTIEMPLOYER PLAN SPONSORS TO SUBMIT CERTAIN PLAN AMENDMENTS FOR THE PBGC'S APPROVAL. TO MAKE THE STATUTORILY MANDATED FINDING WITH RESPECT TO THE RISK CREATED BY AN AMENDMENT, PBGC NEEDS TO EXAMINE THE AMENDMENT AND THE PLAN'S FINANCIAL SITUATION.
