THIS IS A FINAL REGULATION PROVIDING
GUIDANCE ON THE SCOPE OF THE TERM "PENSION PLAN" UNDER ERISA, AS
AMENDED BY THE 1980 MULTIEMPLOYER ACT. THE REGULATION ITSELF IS
INTENDED TO ENABLE EMPLOYERS TO PROVIDE FOR CERTAIN SUPPLEMENTAL
RETIREMENT INCOME PAYMENTS TO FORMER EMPLOYEES UNDER A WELFARE
PLAN, RATHER THAN UNDER A PENSION PLAN, TO HELP OFFSET THE EFFECTS
OF INFLATION ON PENSION BENEFITS. THE SUBJECT OF THIS SF-83 IS A
"SAFE HARBOR", ETC.
On behalf of this Federal agency, I certify that
the collection of information encompassed by this request complies
with 5 CFR 1320.9 and the related provisions of 5 CFR
1320.8(b)(3).
