AUTHORITY TO PLACE OR WAIVE LIENS IN ACCORDANCE WITH THEIR OWN
PROCEDURES SO LONG AS THE USE OF THE DISCRETIONARY AUTHORITY
COMPLIES WITH THE INTENT OF SECTION 408 SMCRA. WHERE LIENS DO NOT
APPLY STATES OR TRIBES ARE NO LONGER REQUIRED TO DO
APPRAISALS.
